Privacy Policy

This Privacy Policy explains how we collect, use, share, and protect your personal information when you use the Clan Ó Comáin membership platform at ocomain.org and associated subdomains (the "Platform").

1. Data controller

The data controller for personal information processed via the Platform is Moohane LLC, 30 N Gould St, Ste 36809, Sheridan, WY 82801, USA ("we", "us", "our"). For privacy questions, write to clan@ocomain.org with "Privacy" in the subject line.

The Chief of Clan Ó Comáin and the Privy Council are not data controllers under this Policy and do not independently process member data; the Operator processes data on behalf of the membership platform under a brand and heritage licence.

2. Information we collect

You provide directly

  • Account and membership: name (in English and, where given, Irish), email address, postal address (where provided for certificate delivery), country, surname-variant context, family or ancestral information you choose to share.
  • Payment: billing details, processed by Stripe — we do not store full card numbers on our systems.
  • Correspondence: emails you send to us, application chat content, and any other information you submit through forms.
  • Gift memberships: where you gift a membership, the recipient's name, email, and optional message.

Collected automatically

  • Usage data: IP address, browser type, pages viewed, referring URL, timestamps. Used for security, analytics, and platform improvement.
  • Cookies and similar technologies: see Section 7 below.

4. How we share your information

We share personal information only as needed to operate the Platform and only with the categories of recipients below. We do not sell your personal information.

We may also disclose information where required by law, by court order, or to protect the rights, property, or safety of the Operator, members, or others.

5. International transfers

Because the Operator is based in the United States and uses primarily US-based service providers, your personal information is processed in the USA. Where we transfer personal data of EU, UK, or Swiss residents internationally, we rely on appropriate safeguards including the EU Standard Contractual Clauses, the UK Addendum, the EU-US Data Privacy Framework where the recipient is certified, and other lawful transfer mechanisms.

6. How long we keep your information

We retain personal information for as long as your membership is active, and for a reasonable period thereafter to comply with legal, tax, accounting, and dispute-resolution obligations. The clan Register may retain a member's name beyond cancellation as a historical record of past membership, with personal contact details removed on request.

7. Cookies and analytics

The Platform uses a small number of strictly necessary cookies for authentication and session management, and may use privacy-respecting analytics to understand site usage. We do not use advertising cookies or third-party tracking pixels for marketing purposes. Where consent is required by your local law (such as the EU ePrivacy Directive), we will request it before placing non-essential cookies.

8. Your rights

Depending on where you live, you may have the following rights in relation to your personal information:

  • Access: request a copy of the personal information we hold about you;
  • Rectification: ask us to correct inaccurate or incomplete information;
  • Erasure: ask us to delete your information, subject to legal retention requirements;
  • Restriction: ask us to limit how we use your information;
  • Portability: request a portable copy of certain information;
  • Objection: object to processing based on legitimate interests, including direct marketing;
  • Withdrawal of consent: where processing is based on consent, you may withdraw it at any time;
  • Complaint: lodge a complaint with your local data protection authority.

To exercise these rights, write to clan@ocomain.org. We respond within thirty (30) days; for complex requests we may extend this by a further sixty (60) days with notice.

For California residents: under the California Consumer Privacy Act (CCPA), you have additional rights including the right to know what personal information we collect and to request deletion. We do not sell or share personal information for cross-context behavioural advertising as those terms are defined under the CCPA.

9. Security

We implement reasonable technical and organisational measures to protect personal information against unauthorised access, loss, or alteration. No system is perfectly secure; if you believe your account has been compromised, write to us immediately.

10. Children

The Platform is not directed at children under 16, and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will promptly delete it.

11. Changes to this Policy

We may update this Policy from time to time. Material changes will be notified by email and posted here with a revised "Last updated" date. Continued use of the Platform after a change constitutes acceptance of the revised Policy.
