Terms of Service

These Terms of Service ("Terms") govern your use of the Clan Ó Comáin membership platform and related services (the "Platform"), accessible at ocomain.org and associated subdomains. By creating an account, joining as a member, gifting a membership, or otherwise using the Platform, you agree to be bound by these Terms.

1. Who we are

The Platform is operated by Moohane LLC, a limited liability company organised under the laws of the State of Wyoming, USA, with principal address at 30 N Gould St, Ste 36809, Sheridan, WY 82801, USA ("we", "us", "our", or the "Operator").

The Operator runs the Platform under a brand and heritage licence from the Chief of Clan Ó Comáin. The Chief, the Privy Council, and Clan Ó Comáin itself are not parties to these Terms and have no legal liability under them. All commercial transactions on the Platform are between you and the Operator.

2. What membership is

Membership of Clan Ó Comáin via the Platform is a contribution to a heritage and cultural revival project. It includes specified digital and, where applicable, physical benefits described on the Platform's membership pages — for example, entry in the Register of Members, a membership certificate, access to clan content, and (for paying tiers) priority for clan events.

Membership is not:

  • An investment, security, or financial product;
  • A grant of any title, peerage, dignity, or office recognised by any state, court, or heraldic authority;
  • A determination of genealogical descent, surname inheritance, or membership of any kindred at law;
  • A charitable donation deductible against tax in any jurisdiction;
  • A guarantee of recognition by the Office of the Chief Herald of Ireland, Clans of Ireland, or any other body.

3. Heritage content and scholarly claims

The historical, genealogical, archaeological, and scholarly content presented on the Platform — including the Pedigree, Heartlands, Surname Variants, and related pages — represents an evidenced reading of the surviving sources, drawing on published scholarship which is cited throughout. Reasonable scholars may differ on individual points. We make no warranty that any specific historical claim is settled fact, and you acknowledge that the heritage narrative is a cultural and scholarly synthesis rather than a legal determination.

4. Eligibility and account

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to enter into a paid membership. You agree to provide accurate registration information and to keep it current. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

We may refuse, suspend, or terminate any membership at our discretion where we reasonably believe that continued membership would be inconsistent with the cultural mission of the clan, the safety of other members, or applicable law.

5. Payment, renewal and pricing

Paid memberships are charged in the currency and at the price displayed at the point of purchase. Payments are processed by Stripe Payments Europe, Limited or its US affiliate. Annual memberships renew automatically on the anniversary of purchase unless cancelled in advance via the member dashboard or by writing to clan@ocomain.org. Life memberships are a single payment with no renewal.

We may change pricing for future periods on at least thirty (30) days' notice. Existing members continue at their original price for the balance of any prepaid term.

6. Cancellation and refunds

Refund terms are set out in our Refund Policy, which forms part of these Terms. In summary: you may cancel within fourteen (14) days of an initial purchase for a full refund, save where benefits have been substantially delivered. Renewals and life memberships are non-refundable except where required by applicable law.

7. Member conduct

You agree not to use the Platform to harass other members, misrepresent your descent or relationship to the clan, infringe any third party's rights, transmit unlawful content, or interfere with the Platform's operation. You will not use clan branding, the clan crest, or membership status to mislead others about any official endorsement, charitable status, or legal authority.

8. Intellectual property

All content on the Platform — including text, scholarly synthesis, photographs, illustrations, the clan crest, and the certificate design — is owned by or licensed to the Operator and is protected by copyright and other intellectual property laws. Members are granted a personal, non-exclusive, non-transferable licence to view and download content for personal, non-commercial use. Use of the clan crest by members is subject to the conditions stated on the membership page and may be withdrawn.

9. Third-party services and links

The Platform integrates third-party services including Stripe, Supabase, Resend, Netlify, and others. Their use of your data is governed by their own terms and is summarised in our Privacy Policy. Links to external sites are provided for convenience and do not constitute endorsement.

10. Disclaimers

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free from harmful components, or that any specific historical or genealogical claim made on the Platform is accurate as a matter of legal or scholarly fact.

11. Limitation of liability

To the maximum extent permitted by law, the Operator's total cumulative liability to you for any and all claims arising out of or related to these Terms or your use of the Platform shall not exceed the greater of (a) the total amount paid by you to the Operator in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred US dollars (US$100). The Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, goodwill, or data, even if advised of the possibility of such damages.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

12. Indemnity

You agree to indemnify and hold harmless the Operator, its officers, members, agents, and affiliates — and separately the Chief of Clan Ó Comáin and members of the Privy Council in their personal capacities — from and against any claim, loss, or expense arising out of your breach of these Terms, your misuse of the Platform, or your violation of any third party's rights.

13. Termination

You may terminate your membership at any time via your dashboard or by writing to us. We may terminate or suspend your access to the Platform on notice for material breach of these Terms or for legal compliance reasons. On termination, sections 8 (Intellectual property), 10 (Disclaimers), 11 (Limitation of liability), 12 (Indemnity), and 14 (Governing law) survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or your use of the Platform shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, with the seat of arbitration in Sheridan, Wyoming. You agree to waive any right to participate in a class action, class arbitration, or representative proceeding.

If you are a consumer ordinarily resident in the European Union, the United Kingdom, or another jurisdiction whose mandatory consumer-protection rules give you additional rights, those rights are not affected by this section, and you may bring proceedings in the courts of your habitual residence to the extent required by applicable law.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email to your registered address and posted on this page with a revised "Last updated" date. Continued use of the Platform after a change constitutes acceptance of the revised Terms.
